Terms of Use

Last updated: May 31, 2026. These terms apply to purchases from WCKD Marketing®, Inc. and use of the WCKD Forms on this site. See also our Licence Policy and Sales and Refunds policy. If you do not agree, do not purchase, download, or use the software.

1. Acceptance of Terms and Commercial Representation

By accessing or using WCKD Forms, a digital product provided by WCKD Marketing®, Inc., you agree to be bound by these Terms of Use. If you are an entity engaged in any commercial use of WCKD Forms, you represent and warrant that you have the legal authority to bind to these Terms those employees and representatives to whom you make the product available. You further acknowledge that you are using this product for commercial purposes and not as an individual consumer.

2. User Responsibilities and Data Sovereignty

WCKD Forms is a self-hosted software application. You retain absolute ownership of all data, text, forms, and information collected through WCKD Forms ("User Content"). Because WCKD Forms utilizes a database-first pipeline, all submissions are written directly to your server's database. WCKD Marketing®, Inc. does not sync, host, copy, or have any access to your form submissions or User Content. You are solely responsible for the legality, reliability, and appropriateness of your User Content. You warrant that you will collect, use, and have access to data about your end-users in strict compliance with all applicable privacy laws (including PIPEDA), and that you have obtained all necessary informed consent. WCKD Marketing®, Inc. is not responsible for the collection, use, storage, or disclosure of data by you related to your customers' use of your forms.

3. Third-Party Integrations and API Liability

WCKD Forms offers integrations with third-party services (e.g., SMTP providers, webhooks, CRMs). You must separately obtain any necessary permissions or licenses to any Third-Party Services that you permit to be used with WCKD Forms. If a Third-Party Service modifies its API, ceases operations, or breaks integration with WCKD Forms, we hold no liability. To the maximum extent permitted by applicable law, WCKD Marketing®, Inc. will not provide you with any refunds for disruptions caused by such Third-Party Services.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WCKD Marketing®, Inc. BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF WCKD FORMS. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNTS ACTUALLY PAID BY YOU TO WCKD Marketing®, Inc. IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

5. Indemnification

You agree to defend, indemnify, and hold harmless WCKD Marketing®, Inc. and its employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your breach of these Terms, your violation of any third-party right, or any claim that your User Content caused damage to a third party.

6. Changes

We may update these terms by posting a new version on this page. Material changes apply to new purchases and renewals after the posted date.
